Terms of Service
In short. You must be 13 or older. What you build stays yours, but it is public and you let us show it. A place on the globe is a license you keep by paying its tax, not property. Hex is play money: it has no cash value and cannot be transferred or cashed out. Purchases are delivered at once and, as a courtesy, refundable within 14 days if you have not spent any of them. Follow the Content Policy; we can remove content and suspend accounts, and you can appeal. Delaware law applies, without taking away the consumer rights of where you live.
1. Who we are and what these terms cover
These Terms of Service (the "Terms") are an agreement between you and Hexagon Place, Inc., a Delaware corporation ("Hexagon Place, Inc.", "we", "us"). Our address and contact details are on the Legal page.
They cover everything we operate (the "Services"): the Hexagon Place platform on the web (hexagon.place), on desktop including Steam, and on iOS and Android; the public sites hexagonplace.world (the live broadcast), hexagonplace.art (the creation gallery) and hexagonplace.org (the feedback hub); our documentation and websites; GlobeGo; and SlowCompact. The Privacy Policy, the Content Policy and the Copyright and DMCA page are part of these Terms.
By creating an account, signing in, or using the Services in any way, you agree to these Terms. If you do not agree, do not use the Services. If you got an app from Apple, Google or Steam, that store's terms also apply to your download and to purchases made through the store; where they conflict with these Terms about such a purchase, the store's terms govern that purchase.
2. Age requirements
- You must be at least 13 years old to use the Services. The Services are not directed at children under 13, and we delete the account of anyone we learn is under 13.
- If you are 13 to 17, you may use the Services only with the permission of a parent or legal guardian who has read these Terms and agrees to them on your behalf. That parent or guardian is responsible for your use of the Services and for any purchases.
- If the law where you live sets a higher age for agreeing to terms like these without a parent, that age applies to you.
- We may ask for your date of birth, use the age information that Apple, Google or Steam give us, and limit chat, free-text names, the live broadcast or other social features based on age. We use age information only for safety.
3. Your account
You sign in through a sign-in provider: an email sign-in link, Apple, Google or Steam. The provider handles your credentials; we never see your password. You agree to:
- use one account per person, for yourself only, and not sell, rent, share or transfer it;
- keep your sign-in method secure and tell us at once if you think your account has been used without your permission;
- choose a display name that follows the Content Policy. We may change or reclaim a display name that breaks the rules, impersonates someone, or is needed for another purpose;
- accept that you are responsible for everything done through your account.
We may ask you to confirm your acceptance of these Terms, your age, or other consents from time to time, and we keep a record of those confirmations.
4. Places, creations and collaboration
The Hexagon Place world is a shared globe divided into cells. A place is one cell you can take and hold; what you build there is a creation. The rules:
- A place is a license, not property. Taking a place gives you a limited, revocable, non-transferable license to build in that cell for as long as its land tax is paid. It gives you no rights of any kind in real land, and no rights against anyone outside the game.
- Tax keeps the place. Tax is prepaid in hex to a date. We can change tax rates, and we announce changes before they take effect; a change never shortens time you have already paid for.
- When payment stops. After the paid-through date, the place is frozen for a 14-day grace period in which only you can pay to restore it, at no penalty. After that, the place is open: the next person who takes it inherits what stands there, and your creation is archived (see Section 7). You may also release a place at any time; releasing it does not refund hex.
- Collaborators. The holder of a place may invite others to build on it. Collaborators' work is subject to these Terms, and the holder may remove collaborators and restore work they deleted. We are not a party to arrangements between you and your collaborators.
- Capacity and limits. Each place has a capacity, and we may set limits on what, where and how much you can build.
- No guarantee of persistence. We may move, reset, protect, remove or reconfigure places and creations when the world, the rules or the law require it (for example to protect a real-world site, to fix an exploit, or to comply with a legal order). We try to tell you first when we can.
5. Hex and lumen
The Services use two in-game units: hex, which you buy, receive as a welcome bonus, or receive through tips and referral credits; and lumen, which regenerates over time. Both are "Virtual Items". You agree that:
- Virtual Items are a limited, personal, revocable, non-transferable license to use features of the Services. You do not own them. They are not money, property, deposits or investments, and they have no cash value.
- Virtual Items cannot be transferred between accounts, sold, traded, exchanged for money or anything of value outside the Services, or cashed out. Any offer to do so, by you or anyone else, is against these Terms.
- We may change what Virtual Items can do, change their prices, set balance limits, expire or convert them, or discontinue them, with reasonable notice where feasible. If we discontinue hex entirely, we will tell you how to use what you have first.
- Spending is final. Hex spent on building, land tax, publishing or other features is not returned when you delete what you built, release a place, or let it lapse. The exceptions are an undo within 60 seconds of a build, and a removal by us that turns out to be a mistake, in which case the hex returns to your personal balance.
- Place balances are one-way. Hex you put into a place (including tips you give to someone else's place) can be spent only on that place and never comes back to a personal balance. Any balance left on a place when it changes hands is forfeited.
- Referral credits are a share of the first purchase made by a player who arrived through your creation. The program's rates, caps and conditions can change, and a credit is reversed if the purchase is refunded.
- We may remove Virtual Items obtained through an exploit, a bug, a refunded or charged-back purchase, or a breach of these Terms.
6. Purchases, refunds and cancellation
Where you buy. On iOS, Android and Steam, purchases are made through the store, which bills you and applies its own refund rules; contact the store first for a refund, and we will support your request. On the web, purchases are sold by our merchant of record, Lemon Squeezy, which is the seller of record, collects any sales tax or VAT, issues the receipt and processes refunds under its terms.
Prices are shown before you pay, including taxes where the law requires. We can change prices for future purchases at any time.
Immediate delivery. Hex is delivered to your account as soon as the payment is confirmed. If you are a consumer in the EU, the UK or another place with a right to cancel a purchase within a set period, you agree that delivery begins immediately when you buy, and you acknowledge that you lose that right once delivery has begun. You will be asked to confirm this at checkout.
Our refund policy. Whatever the law requires, we offer this: if you ask within 14 days of a purchase and you have not spent any of the hex from it, we refund the purchase in full. After 14 days, or once any of it is spent, purchases are not refundable except where the law requires. Hex received as a bonus, tip or referral credit, hex spent on anything, place balances and land tax are never refunded. Where the law where you live gives you a longer or wider right (for example the seven-day right for unused digital content in South Korea), we honor it.
Chargebacks and refunds reverse hex. If a purchase is refunded or charged back, we remove the hex it bought from your paid balance. That balance may go negative, and we may restrict your account until it is settled. We never take back a build or a place balance because of someone else's refund.
Subscriptions. If we offer a subscription, it renews automatically at the stated interval until you cancel. Cancel through the store or your account settings; cancellation takes effect at the end of the paid period, and partial periods are not refunded except where the law requires.
7. Your content
"Your Content" is everything you create or submit through the Services: builds and creations, titles and descriptions, display names, chat messages, tours, templates, feedback-hub posts and anything else.
- You keep what you own. We claim no ownership of Your Content.
- You give us a license to run and promote the Services. You grant Hexagon Place, Inc. a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, copy, adapt (for example to re-encode, scale, snapshot or render it), publish, display, perform and distribute Your Content, and to make it available to other users and to the public, in order to operate, improve and promote the Services, including on hexagonplace.world, hexagonplace.art, store pages, social media and marketing. This license lasts as long as Your Content is in the Services, with these extensions:
- A published creation is archived when its place changes hands, so that its page on hexagonplace.art and any links to it keep working. The license continues for the archived creation.
- Content that remains in the world after you leave (blocks on a place someone else now holds, or in a shared build) stays under the license, without your name once your account is deleted.
- Copies in backups, and in screenshots, recordings and shares that other people have already made, may persist.
- Everything is public unless you say otherwise. The world is shared: other people see what you build as you build it, and they may screenshot, record and share it. A creation can be published, unlisted (visible by link) or private (not shown on the public sites); the live world itself is always visible to whoever is nearby.
- Remixing. If a feature lets you mark a creation as remixable, you allow other users to copy and adapt it inside the Services, with attribution to you where the feature provides it.
- Collaborative work is licensed by each contributor on the same terms.
- Moral rights. To the extent the law allows, you waive, or agree not to assert against us and our licensees, moral rights in Your Content for the uses this Section permits.
- You are responsible for Your Content. You confirm that you have the rights needed to post it and to grant this license, that it does not infringe anyone's rights, and that it follows the Content Policy. If you used AI tools or other people's materials, you are responsible for having the right to use them.
- Feedback. If you send us ideas, suggestions or bug reports, you allow us to use them freely without any obligation to you.
- We do not use Hexagon Place content to train AI models.
8. Rules of conduct
The Content Policy says what you may not build, say or share. In addition, you agree not to:
- cheat, exploit bugs, use bots, scripts or automation to play, or interfere with other players' use of the Services;
- scrape, crawl or bulk-collect data about other users, or access the Services other than through the clients we provide or document;
- probe, scan or attack our systems, bypass access controls, rate limits or regional restrictions, or disrupt the Services;
- reverse engineer, decompile or extract the source code of the Services, except to the extent the law allows despite this Term;
- use the Services for anything illegal, or in a place or in a way that United States sanctions or export laws prohibit;
- sell, buy or advertise accounts or Virtual Items, or run any scheme that turns hex into money;
- help anyone else do any of the above.
9. Moderation, restrictions and appeals
We may remove or hide content, unpublish creations, restrict features, suspend or terminate accounts, and preserve records, as the Content Policy describes, when content or conduct breaks these Terms, breaks the law, or puts other people or the Services at risk. Where we can, we tell you what we did and why, and you may appeal by email within 30 days. We may act without notice where the law, a safety risk, fraud or a legal order requires. We are not responsible for content other users post, but we act on reports and on what we find.
10. The live broadcast and the gallery
- hexagonplace.world follows live players and tours public creations, and anyone can watch it. While you are online you may be shown there by your display name; no identifier, coordinates or follow link is published. You can stay off it at any time with the "Appear on the live broadcast" switch in the web client's settings. The choice follows your account on every device. Your public creations still appear, without your name.
- hexagonplace.art gives every public creation a permanent page and every creator a page. It shows what you have published and, after your land changes hands, the archived version. The same switch hides your name there too.
- Both sites, and embeds of them, may be viewed, screenshotted and shared by anyone.
11. Location features and real-world safety
- On mobile, unlocking territory uses your device's location while the app is in use. We store only the coarse map cell of each unlock (about 36 square kilometers), never your precise position. Location is optional; the Privacy Policy has the details.
- For any location-based play, including GlobeGo, you are responsible for your own safety and for obeying the law. Stay aware of your surroundings, do not play while driving or cycling, do not trespass, and do not enter dangerous or restricted areas. To the extent the law allows, Hexagon Place, Inc. is not liable for injury, death or property damage that occurs while you play.
- Do not use the Services to track, locate or target a real person.
12. Our intellectual property and copyright complaints
The Services, including their software, terrain and world data, meshes, designs, names, logos, documentation and the compilations of user content we make, are owned by Hexagon Place, Inc. or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services under these Terms. Everything not expressly granted is reserved. Open-source components we use are licensed under their own terms.
If you believe content in the Services infringes your copyright or other rights, follow the Copyright and DMCA page. We terminate the accounts of repeat infringers.
13. Stores and other third-party services
The Services depend on third parties: Apple, Google and Valve (Steam) for distribution, sign-in and store purchases; Lemon Squeezy for web purchases; Cloudflare for delivery and security; Clockwork Labs (SpacetimeDB) for hosting the world; and others listed in the Privacy Policy. Their terms apply to your use of their services, and we are not responsible for them. Apple, Google and Valve are third-party beneficiaries of these Terms for the apps distributed through their stores and may enforce them against you.
14. Beta, Early Access and changes to the services
The Services are in active development. Features may be labeled beta, preview or Early Access; they may change, break or be removed, and the beta environment (hexagonplace.xyz and the apps' beta channels) may be reset at any time, erasing everything in it. We may add, change, suspend or discontinue any part of the Services at any time. Where a change materially reduces a paid feature, we tell you in advance where feasible and offer a remedy where the law requires.
15. Changes to these terms
We may change these Terms. For material changes we give at least 30 days' notice where feasible, in the app, by email where we have your address, or on our sites, and we post the date of the last update at the top. If you keep using the Services after a change takes effect, you accept it. If you do not accept it, stop using the Services; you may delete your account at any time (Section 16).
16. Ending your account
- By you. Delete your account in the iOS or Android app (Profile → Account Actions → Delete Account) or by emailing legal@hexagonplace.com from the web or desktop. The Privacy Policy describes what deletion removes.
- By us. We may suspend or terminate your account for a breach of these Terms, for conduct that harms other users or the Services, when the law requires, or if we discontinue the Services.
- Effect. Your places are released, your Virtual Items are forfeited (except any refund the law requires), and the licenses in Section 7 end or continue as that Section describes. Sections 5 to 7, 9, 12 and 17 to 22 survive.
17. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Services will be uninterrupted, error-free, secure, or that content will be preserved. User content is not endorsed by us. If you are a consumer, nothing in this Section removes guarantees that the law where you live gives you and that cannot be excluded.
18. Limitation of liability
To the fullest extent the law allows, Hexagon Place, Inc. and its officers, directors, employees, contractors and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or Virtual Items, arising from or related to the Services or these Terms, however caused. Our total liability for all claims arising from or related to the Services or these Terms is limited to the greater of US$100 and the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for anything else that cannot be limited or excluded under the law that applies to you. If you are a consumer in the EU or the UK, we are liable for foreseeable loss caused by our breach of these Terms or by our negligence, and this Section applies only to the extent permitted by the law where you live.
19. Your responsibility for your content and conduct
To the extent the law allows, you will defend, indemnify and hold harmless Hexagon Place, Inc. and its officers, directors, employees and contractors from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms or of the law. This does not apply to a consumer where the law where they live does not permit it.
20. Governing law and disputes
Talk to us first. If you have a dispute with us, email legal@hexagonplace.com with a description of the problem and what you would like us to do. We will try to resolve it informally within 30 days before either of us starts a formal proceeding.
Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act and United States federal law where they apply.
Courts. Any dispute that is not resolved informally will be brought in [the state or federal courts located in the State of Delaware — counsel to confirm the venue], and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court where it qualifies.
Consumers keep their rights. If you are a consumer in the EU, the UK, or anywhere else whose law gives you the benefit of mandatory consumer protections and the right to bring proceedings in the courts of your home country, nothing in this Section takes those away. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
21. Notices for the EU and the UK
- Point of contact. For users and for authorities, including under the EU Digital Services Act (Articles 11 and 12): legal@hexagonplace.com, in English. Our EU and UK representatives are named on the Legal page.
- Illegal content. How to notify us, what we do, and how to appeal are in the Content Policy. We explain restrictions we impose and the reasons for them.
- Our rules for content are the Content Policy; we apply them diligently, objectively and proportionately, with regard to the rights and interests of everyone involved.
- Purchases. The withdrawal information in Section 6 applies. Our merchant of record provides the receipts and tax documents required in your country.
- Hexagon Place, Inc. is a micro-enterprise under the Digital Services Act; the obligations that apply only to larger providers do not apply to us.
22. General terms
- Entire agreement. These Terms, with the policies they incorporate, are the whole agreement between you and us about the Services and replace any earlier agreement.
- Severability. If any part of these Terms is unenforceable, it will be enforced to the extent permitted and the rest remains in effect.
- No waiver. If we do not enforce a Term, that is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them to an affiliate, a successor or a buyer of the Services, and will tell you if we do.
- Sanctions and export. You confirm that you are not in a country or region subject to comprehensive United States sanctions, and not on any United States list of restricted parties, and that you will comply with export laws.
- Language. These Terms are written in English. A translation we provide is for convenience; the English version governs where the law allows.
- Notices. We may notify you in the app, by email where we have your address, or on our sites. Notices to us go to legal@hexagonplace.com or the address on the Legal page.
