Copyright and DMCA
Hexagon Place, Inc. respects the intellectual property of others and expects the people who use our services to do the same. Our users keep the rights to what they create (see the Terms of Service). This page explains how to tell us that something in our services infringes your copyright, what we do about it, and how a user can respond. We follow the notice-and-takedown procedure of the United States Digital Millennium Copyright Act (17 U.S.C. § 512) and the notice-and-action rules of the EU Digital Services Act (Article 16).
1. Designated copyright agent
| Name | Hexagon Place, Inc., Attn: Copyright Agent |
|---|---|
| Address | [registered address] |
| Phone | [phone number] |
| legal@hexagonplace.com (preferred) |
[Register this agent with the U.S. Copyright Office at dmca.copyright.gov before publishing, and keep the listing identical to this table.]
2. Reporting infringement
Send a notice to the agent above that includes:
- your physical or electronic signature, or that of someone authorized to act for you;
- the copyrighted work you believe has been infringed (or, for several works, a representative list);
- where the infringing material is in our services, precisely enough for us to find it: a creation link from hexagonplace.art, the place and its location on the globe, the display name of the player who made it, or the display name and time of a chat message, with a screenshot if you have one;
- your name, address, phone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.
Incomplete notices may be returned for completion. Please do not send notices about other matters to this address; use the Content Policy for safety reports.
3. What we do with a notice
When we receive a complete notice, we remove or disable access to the material promptly, notify the user who posted it and give them a copy of the notice (without your phone number and address unless you ask us to include them), and record the notice against the user's account. We may also tell the user how to file a counter-notice.
4. Counter-notice
If your content was removed and you believe the removal was a mistake or a misidentification, send a counter-notice to the agent above that includes:
- your physical or electronic signature;
- the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if you are outside the United States, any judicial district in which Hexagon Place, Inc. may be found), and that you will accept service of process from the person who filed the original notice or their agent.
We forward counter-notices to the person who filed the original notice. If they do not tell us within 10 business days that they have filed a court action to restrain the alleged infringement, we may restore the material 10 to 14 business days after receiving your counter-notice.
5. False claims
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including the costs and attorneys' fees of the person harmed. Please make sure that your claim is accurate and that you have considered whether the use is fair use or otherwise lawful before sending a notice.
6. Repeat infringers
We terminate the accounts of users who repeatedly infringe copyright. We may also terminate an account after a single severe infringement. A notice withdrawn by the claimant, or answered by a counter-notice that the claimant does not contest, is not counted.
7. Notices from the EU and the UK
You can use the same address and the same elements for notices under the EU Digital Services Act and the UK rules. Say that you are notifying illegal content, explain why you consider it illegal, give the exact location of the content, your name and email address, and a statement that your notice is accurate and complete. We will confirm receipt, tell you our decision and the reasons for it, and tell you how to appeal. See the Content Policy.
8. Trademark and other rights
For trademark, publicity or other intellectual-property complaints, email legal@hexagonplace.com with the right you hold (with registration details where they exist), where the content is in our services, why it infringes, your contact details and a statement that your complaint is accurate.
